THE RACE COURSE, EVENT FORMAT AND CUTOFF TIME

The cutoff time for the marathon is 8 hours. I understand that the organizers’ objective is to establish the course on a floating ice floe at or near the Geographic North Pole. I understand and agree that in the event suitable ice cannot be located and secured at the North Pole, the course may be arranged, in whole or in part, on board.

I further understand that this event takes place in one of the world’s most extreme and remote environments, where conditions can change rapidly and unpredictably, including but not limited to winds, fog, sea ice conditions, ocean movement and waves, wildlife activity including polar bears, governmental, international, regulatory, or other external restrictions, safety considerations, and other operational constraints. Such conditions may require modifications to the course, event format, schedule, activities, or operations.

While the organizers’ objective is to reach the Geographic North Pole (90°N), which has been successfully achieved in past years, this cannot be guaranteed due to weather, ice, operational, environmental, regulatory, or safety considerations.

No refund, compensation, or damages shall be owed as a result of modifications, interruptions, delays, rerouting, inability to reach 90°N, or, in exceptional circumstances, cancellation of the event arising from weather, ice, operational, safety, environmental, governmental, international, regulatory, wildlife, national, or force majeure conditions.

General terms and conditions of the vessel

I understand and agree with the general Terms and Conditions of Le Commandant Charcot, the ship that will be used for this trip, which can be viewed here: General Terms and Conditions.

In the event of any disparities between the terms in the general Terms and Conditions of Le Commandant Charcot and Runbuk's Terms regarding the same subjects, Runbuk's Terms will apply.

DECISIONS OF THE VESSEL’S CAPTAIN

I acknowledge and accept that during the cruise, the captain of the icebreaker shall have complete and unrestricted discretion to act in any way considered appropriate: (i) for the comfort, safety, and security of the persons on board the vessel, (ii) for the safety and security of the vessel, (iii) to save lives at sea, (iv) to preserve the environment, (v) to comply with applicable laws and regulations, and (vi) to maintain the good order of the vessel.

The captain may, therefore, at their sole, just, and reasonable judgment: (a) modify the Itinerary as described; (b) refuse to transport any person and/or luggage at any stage of the cruise; (c) embark and/or disembark any person and/or luggage; (d) take any action to comply with the instructions and/or regulations of public and/or local authorities; (e) take any action to protect the vessel and/or the well-being of persons on board; (f) take any action to save lives at sea; (g) require to stop the running activities on board the vessel or onshore.

USE OF IMAGE

I understand that during the running race or in related activities, I may be photographed, filmed, and/or videotaped. (In cases where there are Army Special Forces involved, Runbuk Inc. will agree to protect identities as requested).

VOLUNTARY PARTICIPATION AND ASSUMPTION OF RISK

I acknowledge that I have willingly applied to take part in the North Pole Marathon, encompassing runs of various distances. I have thoroughly reviewed and comprehend the expedition's descriptions, terms, conditions, and recommendations. I am participating in this journey fully aware of any potential hazards. Additionally, I understand that the trip dates and departure point specified on this form may be subject to change.

I understand that the North Pole, and Arctic Ice Pack, is over 2,000 km across and will be desolate of many western standard rescue facilities. I understand that I will be lodging on an an icebreaker, and running on a floating ice that's 3 feet thick or even thiner on top of the Arctic Ocean, and that sudden cracks (leads), pressure ridges, and ocean currents can expose the ocean at any time; that temperatures in April can be below -10 degrees Celsius, with wind chills to -100 degrees Celsius; that bad weather and aircraft or machinery malfunction could strand the expedition for many days; that prolonged exposure to the polar environment can cause loss of fingers, toes, and body parts due to frostbite, or loss of life due to many causes including hypothermia, dehydration or even drowning or polar bear attacks.

I further understand that Runbuk Inc., the Race Director and other organizers cannot 100% guarantee the safety of competitors when transporting them since this expedition will be carried out in one of the harshest and most remote environments on earth.

Furthermore I understand that participating in physical activities in the North Pole area may put me at some risk of death, falling or being blown into the frigid waters and other perils. I also agree that the specific activity of running or walking in the North Pole vicinity may, in an extreme worst case scenario, place me at risk of death from the frigid conditions as well as being lost in the Arctic due to poor weather or loss of communication as well as accident or illness, fully understanding that I am in a remote region devoid of many medical supplies and facilities.

In consideration of being permitted to participate in this trip, I fully assume responsibility upon myself for such bodily, mental, and financial injuries and delays caused by, but not limited to various surface transportation, accidents, aircraft malfunctions, hazards of traveling in the Arctic environment, forces of nature, civil unrest, terrorism, and other perils. I freely assume these and all other risks inherent in this North Pole Expedition, in exchange for the thrill and adventure of traveling to the Arctic Region.

I hereby assume all risks, however caused, including those mentioned above, as a result of my participation.

RELEASE FROM LIABILITY

I release Runbuk Inc. and all of its agents and representatives or other entities acting on their behalf from any and all liability, actions, causes of actions, suits, debts, and demands that I may have for bodily injury, death, or property damage, loss of income, delays and claims of every sort and nature whatsoever which may arise out of or in connection with my participation in the North Pole Marathon.

GOVERNING LAW AND JURSDICTION

The validity, construction and performance of this Agreement shall be governed in accordance with the laws of the USA. The parties hereby irrevocably submit to the exclusive jurisdiction of the courts of the USA as regards any claim, dispute, or matter arising out of, or in connection with this Agreement.
